Terms of Service

1. The Service

Stampways is a self-service web application for creating and running digital stamp rallies (stamp tours). Participants join a rally in a mobile browser by scanning QR codes or checking in by GPS. The Service includes AI-assisted creation and editing, participant sign-in options, photo uploads, surveys, prize draws and roulettes, statistics and report downloads.

The Service is not offered for running tours inside mainland China or to customers located in mainland China. Participants from any country may join tours that are held outside mainland China.

2. Accounts

• The Service is intended for businesses, local governments and other organizations that run stamp rallies ("Organizers"). You must be at least 18 years old to create an account.
• You must provide accurate account information and keep your login credentials confidential. You are responsible for all activity under your account.
• Please notify us promptly if you suspect unauthorized use of your account.

3. Free use before publishing

You can sign up, create projects, use AI features within a free trial usage allowance, and preview the participant screens free of charge. No payment card is required. A project's preview link can be used by up to 20 people. Preview records are deleted when the project is published. To publish a project to participants, you need a project pass.

4. Prices and payment

• Prices are shown on our pricing page, excluding taxes. Prices are in Korean won for customers in Korea, in Japanese yen for customers in Japan, and in US dollars for customers elsewhere.

• All products are one-time purchases. They are not subscriptions and do not renew automatically. Payment is made at the time of purchase, and purchased passes are added to your account immediately after payment.
• Prices may be displayed in another currency on the pricing page or at checkout. The amount and currency shown at checkout apply to your order. Applicable taxes (such as VAT, GST, sales tax or consumption tax) are calculated and shown at checkout.
• Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Sales to customers in the United States are made by Paddle.com Inc., and sales to customers elsewhere are made by Paddle.com Market Limited.
• Your purchase is also subject to Paddle's Buyer Terms, which govern payment, billing, taxes, cancellation and refund processing. These Terms govern your use of the Service.

5. Project passes and run period

• One pass is used when a project is published for the first time. Unpublishing and republishing the same project does not use another pass.
• Passes must be used within 1 year of purchase. Passes that have not been used within that period expire and can no longer be used.
• A project's run period is 30 days, starting from the day the first participant (excluding test participants) joins the published project, plus any run extension days you have purchased for that project. Publishing a project before your event does not use any days of the run period.
• When the run period ends, participants can no longer join the project or collect stamps. You can still sign in to view statistics and download data and reports for 1 year after the run period ends. After that, participant personal data may be deleted.
• One pass is for one event. You may not reuse one project for different events. If a project is reused in this way, we may charge an additional pass or suspend the project.

6. AI features

• There is no separate charge for AI features in projects with a pass. To prevent abuse, AI features are subject to fair-use limits, such as a daily usage limit.
• Before you make any purchase, AI features can be used within the free trial usage allowance.

7. Refunds

Within 14 days of purchase, unused passes are refunded in full. For a 5-pass or 10-pass bundle in which some passes have been used, the unused passes are refunded pro rata at the bundle's per-pass price. Run extensions are refundable within 14 days of purchase only if the project's run period has not yet started or the extended days have not begun. Otherwise, and after 14 days, payments are not refundable except where required by law. See our Refund Policy for details.

8. Your content and participant data

• You keep all rights to the text, images, spot information and other content you upload to the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process and display Your Content only as needed to provide the Service to you.
• You confirm that you have the rights needed to use Your Content and that it does not infringe the rights of others.
• For personal information of participants collected through your stamp rallies, you are the controller (in Japan, the business operator handling personal information; in Korea, the personal information controller). We process that information on your behalf and according to your instructions as described in our Privacy Policy.
• You are responsible for having a lawful basis to collect participant information, for showing participants a privacy notice, for obtaining any consent required (including for photos, contact details and minors), for choosing an appropriate participant sign-in mode, and for deleting participant information when it is no longer needed. The Service lets you set a retention period and delete participant personal data for each project.
• If a rally is aimed at children, you must obtain parental consent where required by law, or use the anonymous sign-in mode.
• When your account is deleted, we delete Your Content and participant information within a reasonable period, except where we are required by law to keep it.

9. AI-generated content

AI features generate screens, text and images automatically. AI output may be inaccurate, incomplete or similar to third-party content. You must review AI-generated content before publishing it, and you are responsible for the content you publish. We do not guarantee the accuracy, legality or fitness for purpose of AI output. Please do not enter participants' personal information into AI instructions.

10. Prize draws, roulettes and promotions

You are the sole promoter of any prize draw, roulette, giveaway or premium offered through your stamp rally. You are solely responsible for complying with all applicable laws on prizes, sweepstakes, contests, lotteries and premiums, such as Japan's Act against Unjustifiable Premiums and Misleading Representations (景品表示法) and US federal and state sweepstakes laws. This includes official rules, eligibility, prize value limits, any required registration or bonding, taxes, and delivering prizes to winners. MOMSCOACH is not a sponsor of your promotions and does not award prizes.

11. Venues and location features

You are responsible for obtaining any permission needed to place QR codes or run a rally at a venue, and for the safety of the routes and spots you set. GPS check-in depends on the accuracy of participants' devices and is not guaranteed.

12. Prohibited conduct

• Violating any law or regulation, or public order and morals
• Infringing the intellectual property, privacy or other rights of others
• Running a rally to deceive participants or to collect personal information without a legitimate purpose
• Uploading malware, unlawful content or content that is harmful to minors
• Interfering with the Service, gaining unauthorized access, or reverse engineering the Service except as permitted by law
• Reselling or sublicensing the Service without our written consent

13. Changes to and availability of the Service

We may change or improve the Service from time to time. We may suspend all or part of the Service for maintenance, failures or other unavoidable reasons. Where possible, we will give advance notice of planned maintenance.

14. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you materially breach these Terms, if required by law, or if your use creates a risk to the Service or to others. Where reasonable, we will notify you in advance and give you an opportunity to fix the issue.

15. Intellectual property

The Service, including its software, design and trademarks, is owned by MOMSCOACH or its licensors. Except for the right to use the Service under these Terms, no rights are granted to you. If you send us feedback, we may use it without obligation to you.

16. Disclaimer

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement.

17. Limitation of liability

To the extent permitted by law, MOMSCOACH is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising out of or relating to the Service is limited to the amounts you paid for the Service in the 12 months before the event giving rise to the claim. These limits do not apply to liability that cannot be limited by law, including liability for our willful misconduct or gross negligence.

18. Indemnity

You will defend and indemnify MOMSCOACH against third-party claims arising from Your Content, your stamp rallies and promotions, your handling of participant information, or your violation of these Terms or applicable law.

19. Changes to these Terms

We may update these Terms. We will notify you of material changes by email or in the Service at least 14 days before they take effect, unless a change is required sooner by law or for security reasons. If you continue to use the Service after the changes take effect, you agree to the updated Terms.

20. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Korea. The Seoul Central District Court has exclusive jurisdiction as the court of first instance over any dispute relating to these Terms or the Service. This does not deprive you of the protection of mandatory consumer protection laws of your country of residence, where they apply to you.

21. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our consent. These Terms are available in English, Japanese and Korean. If there is any inconsistency between the versions, the English version prevails to the extent permitted by law.
